Subject: Response to Notice ofFraud and Critical WTG Serial Defects & Equipment Defects at the 60MW WindPower Project
Reference: Employer’s letter with reference number-
Dear Sir,
We,, the Contractor and theSupplier, have meticulously reviewed the notice issued by (the “Employer”) and were acutely aware of the severity of theissues raised from the initial notification, since then, the Supplier and theContractor initiated appropriate actions promptly and coordinated with OEM ofWTG equipment. Despite engaging in multiple discussions with SEnergy (Private) Limited, we regret to be informed that000 has yet presented a final investigationplan ( as Attachment 1 000’s reply dated June 18th, 2024). Followingthe 000s reply, an immediate escalation of the matter internally within 000has been actioned, accompanied by insistence on an urgent and thoroughresponse. A senior-level intervention is being implemented to ensure 000 fullycomprehends the gravity of the situation and promptly delivers a comprehensiveinvestigation strategy.
Meanwhile,as Parent Company of the Supplier and the Contractor, we hereby commit that ourteam will conduct a thorough, independent and transparent investigation timelywith OEM and Employer team to determine the root cause of all mentioned issuesand further actions required within a reasonable timeline.
Following the Employer’s demand in letter dated June16th, 2024, our point wise reply is as hereunder:
identify the AuthorizedPersons & Communication Plan
As required,Mr. xxx as xxx of the Parent Companywilltake the lead in the resolution process outlined in the Employer’s notice withthe support of a complete professional team from our company and OEM, who isresponsible for decision-making, implementation, oversight and communicationwith Employer team.
For timely coordination and communication among parties, in the interest of maintaining transparency andefficiency, we pledge to regularly update xxx on theprogression of our dialogues with xxx on weekly basis. This encompassessharing any preliminary findings or updates pertaining to the investigationplan as soon as they are available.
Recognizing the significance of open communication channels andeffective cooperation, we will establish a dedicated task force to work closelyalongside your representatives and xx with the objective of accelerating theresolution process.
Thorough Investigation
Wehereby commit that our team will conduct a thorough, independent andtransparent investigation timely with OEM and Employer team to determine theroot cause of all mentioned issues and further actions required within areasonable timeline. It’s kindly requested the Employer to grant an extendedtimeline for xxx and our company to prepare a detailed and comprehensive planto conduct the investigation.
Remedial Plan
Upon conclusion of the investigation, we are committed to implementing all necessary remedial measures in line with the findings. It’s reasonable to have investigation first, then we make a practical and satisfying remedial plan. We request for your kind understanding and support on the plan preparation.
Warranty Period Extensionand Warranty Bond Extension
Currently, the offshore warranty bond is validtill January 31,2025, andthe onshore warranty bond is valid till July 31,2024. Once the investigation ofall issues raised in the Employer’s notice is completed with conclusion, theEmployer, the Contractor and the Supplier shall have a specific discussion forthe Warranty Period and Warranty Bond in line with the investigation findings.
Independent PerformanceTesting
Our contractual obligations are toensure the compliance of the equipment and “Fit for Purpose”. The Contractorand the Supplier will strictly follow and comply with its obligations under theContracts. It’s recommended to have comprehensive investigation first, then itwould be clear whether taking any further independent performance testing isnecessary.
For the issues raised by the Employer for all mentioned defects, the Supplier and the Contractor will try the best to engage all stakeholders and carry out the comprehensive investigation to have the final conclusion and work out any reasonable and applicable remedial plan.
Weare deeply concerned about the implications of these issues on our partnershipand remain steadfast in our determination to restore faith in our capability tofulfill our obligations. And we fully understand the seriousness of thisincident and will do our utmost to ensure that all issues are properly handled.
