有效订立的合同对当事人具有约束力。// A contract validly entered into is binding upon the parties.
要点
- to enter into 是常用表述,指成为某种法律关系的一方。这里指“订立协议”。再比如,
The parties are free to enter into a contract and to determine it's content. // 当事人可自由订立合同并确定合同内容。
A compromise entered into by one of multiple persons with an interest in the same matter does not bind the others. // 利害关系人一方做出的和解并不约束其他人。
还比如下面的婚姻关系,
应当确保只允许有意结为配偶者在自由和充分同意的情况下结婚。// It has to be ensured that marriage is entered into only with the free and full consent of the intending spouses.

binding : that must be obeyed because it is accepted in law。
“约束力”,意味着合同当事方必须按照约定行事,违约者将受到法律强制。之所以强调“accepted by law”,是因为合同并非自动具有法律约束力,合同约束力来源于受到法律的确认和保护。非法或者明显不义的合同,法律不予保护,就不是一份“legally binding contract”。 -
译法上,在理解原文的基础上,注意灵活调整译文。同样是“to enter into”,分别译为“订立合同”、“做出和解”、“结婚”;原文里“be binding upon”也可以灵活处理为“有效订立的合同,当事人均须遵守”。
